Texas 10-year-old confesses to 2022 murder of sleeping stranger at RV park

A 10-year-old Texas boy confessed to fatally shooting a stranger in 2022 as he slept in his RV, but state law will likely prevent him from being charged in connection with the slaying.

The unidentified boy was just 7 years old — a week away from his 8th birthday — when he killed Brandon O’Quinn Rasberry, according to a press release from the Gonzalez County Sheriff’s Office.

Police found Rasberry dead inside his recreational vehicle at an RV park in Nixon, Tex. on Jan. 18, 2022. He suffered from a single gunshot wound to the head and his cause of death was listed as homicide. He was 32 years old.

“Based on information gathered from the scene, witness statements and the autopsy report from the medical examiner, it was estimated Brandon had been deceased for approximately two days prior to law enforcement’s arrival,” the sheriff’s office said Friday.

Rasberry’s murder remained a mystery for years, with no major breaks until April 12, when a local principal called police to report troubling claims made by a student who recently threatened to assault and kill a classmate on the school bus.

He was being questioned about his behavior by school officials in the Nixon-Smiley Consolidated Independent School District and eventually confessed to shooting Rasberry more than two years ago.

The boy said he was visiting his grandfather, who lived at the same RV park as Rasberry at the time. He told investigators he took a pistol from the glove box of his grandfather’s truck, entered the RV belonging to Rasberry, and shot him.

“The child stated he observed Brandon sleeping in his bed and approached Brandon and discharged the firearm into Brandon striking him one time in the head,” police said. “The child stated as he was leaving the RV he discharged the firearm another time into the couch inside the RV. The child then exited the RV and returned the firearm to the glove box of the truck.”

He also told investigators he did not know Rasberry nor did he have any reason to kill him.

According to Texas law, a child has to be at least 10 years old to have criminal culpability. That means the boy was too young when the crime occurred to face charges for Rasberry’s murder. He was, however, charged in connection with the threat made against his classmate and is in juvenile detention awaiting a court date.
