California man receives 40 years for killing boy, 6, in road-rage shooting



A Southern California man who fatally shot a 6-year-old during a road rage incident, was sentenced Friday to 40 years-to-life in prison.

“I’m truly sorry for taking your beautiful son away from you,” Marcus Eriz, 27, of Costa Mesa, said to victim Aiden Leo’s mother, who was not in court. “I am so sorry for ever hurting him and for the pain that he went through because of me,”

Aiden Leos, 6, was in a booster seat in his mother’s car on the way to kindergarten when he was fatally struck on May 21, 2021.

Eriz was in a car being driven by his girlfriend, Wynne Lee, who cut off Aiden’s mom in traffic on State Route 55. When Lee gave a peace sign, Aiden’s mother responded with a middle finger.

That was when Eriz, opened his window and fired the fatal shot at her car, authorities said.

Defense attorneys asked Orange County Judge Richard King to weigh a doctor’s report with Eriz’s childhood trauma linking to his actions, but King opted for the maximum penalty.

“I don’t think the English language can even attempt for anybody to even describe what Aiden’s mother went through after he said, ‘ouch.’ She pulls over, and her little boy dies in her arms. I don’t think anybody – anybody – can even comprehend what the rest of her life is going to be about how her little boy died,” King said on Friday.

Eriz’s girlfriend, Wynne Lee, is charged with being an accessory after the fact, and is scheduled to appear in court on April 26 for her pretrial hearing.
